TERMS OF SERVICE
The short version
Phonez drives real phones that you own, under your instruction. You are responsible for your devices, your accounts, and everything done through them. These terms say what that means, how billing works, and how either of us can walk away. Last updated September 1, 2026.
Real phones, really driven
Phonez is a Mac app plus a control plane. Your Mac runs the farm; your iPhones and iPads plug into it; you and your team drive those phones from a browser, or let an agent drive them. There are no emulators and no publishing APIs — everything reaches an app the same way a finger would.
You confirm that every phone you enroll is one you own or have the owner's permission to control, and that you're allowed to use any account you point it at. Phonez is built and run by Sam Ovington — “we” and “us” below means that operation.
The agent acts under your instruction
The built-in agent does what you tell it to do on the phones you point it at. When it publishes something through one of your accounts — a post, a caption, a reply — that content is yours. You wrote the instruction or approved the workflow, the account is yours, and you are responsible for what goes out through it.
Platforms like Instagram and TikTok write their own rules about automated activity, and those rules change without telling either of us. If a platform decides your account broke its terms and restricts or bans it, that is between you and the platform. We drive the phone; we can't make a platform's decision go away, and we aren't responsible when one goes badly.
What we do on our side: every action the agent takes is audited against your instruction, captions are verified byte-for-byte before anything publishes, and nothing auto-retries in the blind window after a post is handed to the phone. Those rails reduce mistakes. They don't move the platform risk off your account.
$199.99/month per farm, 5 phones included
One plan: $199.99 per month per farm, billed through Stripe. 5 licensed phones are included. Each licensed phone beyond that is $20 per month, prorated automatically — if you add a phone mid-month, you pay for the days you have it. Unlimited operators and seats: you pay for the phones, not the people.
The subscription renews automatically every month on your billing date, charged through Stripe at the then-current rate ($199.99 plus $20 for each phone beyond 5), until you cancel. Cancel any time from the portal before your next billing date: your plan — including any extra phones — stays active until the end of the period you've already paid for, and no further charges follow. Don't want to renew? That one toggle is all it takes; no email or phone call required. Need out early or stuck cancelling? Email sam@phonepanel.app and we'll sort it out. Payment card data lives with Stripe; we never see your card number.
Refunds have their own section below — short version: 14-day money-back on a farm's first month, cancel-anytime after that.
The built-in agent's model usage is metered from your token balance, and token packs are one-time purchases that don't renew. Going over your phone quota never bricks your farm — existing phones keep working; you just can't license new ones until the bill catches up.
14 days to change your mind
If a farm isn't working out, tell us within 14 days of that farm's first payment — email sam@phonepanel.app — and we'll refund that first month in full: the plan charge and any per-phone proration with it. One money-back per farm; it covers the first month only. After that, the cancel-anytime terms above are the deal: no further charges when you cancel, and no pro-rated refunds for time you've already had. (Buffer runs a 7-day version of this for monthly plans; TeamViewer gives 7 days on new purchases. We picked 14 because a farm takes a week to set up before you even post.)
Token packs are one-time purchases of something you consume: once the agent has spent the tokens, they don't come back. Bought one by mistake? Within 14 days, unused, we'll refund it. If we ever terminate your access for something this page forbids and it turns out we were wrong, you get back what you paid for time you couldn't use.
Phones you own, content you stand behind
- • Control only devices you own or have explicit permission to control. Interfering with someone else's phone, account, or farm is forbidden and will end your access.
- • No unlawful content. Don't use Phonez to publish or do anything illegal where you are — that includes fraud, harassment, and anything involving people who can't consent.
- • Don't use the service to attack, spam, or break things — ours or anyone else's.
- • Driving your own social accounts through a real phone is what the product is for. Whether that complies with a given platform's rules is your call to make, and your risk to carry (see above).
- • Keep the accounts you connect in good standing: follow each platform's own terms for the accounts you drive. The platforms, not us, write and enforce those rules — same duty, stated plainly.
Adults, everywhere the law allows
Phonez is for people 18 or over (or the age of majority where you are, if that's higher). Don't use it from any country or for any purpose that would put us on the wrong side of export-control or sanctions laws, and don't use it if you're named on a sanctions list. That's the whole eligibility section — everything else is the acceptable-use rules above.
If your content ends up somewhere it shouldn't
Everything published through a farm comes from the farm owner's own accounts — but if you believe content published through Phonez infringes your copyright, email sam@phonepanel.app with: the work you own, where it was published, your contact details, a statement that you believe in good faith the use isn't authorized, and a statement that your notice is accurate. We'll pass it to the farm owner whose account it came from, remove what sits on our side of the fence (scheduled posts, drafts, uploaded media), and end the access of anyone who keeps infringing.
If your content was taken down by mistake or misidentified, reply and tell us why — we'll take another look, and we won't just take the first word for it.
Disclaimers and liability, without the fog
Phonez is provided as is. We work hard to keep farms healthy and phones safe — one control session per device, explicit targeting, an audit trail on everything — but we don't promise the service will be uninterrupted, and we don't promise a phone, an app, or a platform will behave the way you expect.
We are not liable for indirect losses: a banned account, a missed post, lost content, lost followers, lost revenue, or anything a platform or a phone does on its own. To the extent the law allows, our total liability to you for anything related to the service is capped at what you paid us in the twelve months before the claim.
Talk to us first, then one arbitrator — never a class action
If something's gone wrong, email sam@phonepanel.app first and give us 30 days to make it right. Most disputes with a one-person company can be settled by one email. If we can't settle it, the claim goes to final and binding arbitration run by the American Arbitration Association under its Consumer Arbitration Rules — and the hearing happens where you are, in the county of your billing address, not wherever we are. You can instead take small claims to your local small-claims court.
You and we each agree to bring claims only in our own name — not as a plaintiff or class member in any class or representative action, and (where the law allows) with no jury trial. If you don't want the arbitration agreement, email sam@phonepanel.app within 30 days of first accepting these terms and it won't apply to you; everything else on this page still does. Nothing here stops either of us from going to a government agency, which can pursue claims on its own.
How this ends
You can cancel your subscription and delete your org from the portal whenever you like — see the privacy page for exactly what deleting removes. If you use Phonez in a way this page forbids — unlawful content, or phones and accounts you have no right to control — we can suspend or end your access, and we'll tell you why when we can.
This page, and the human behind it
We'll update these terms on this page as the product develops; the date at the top is the version you're reading. Questions, problems, or a refund you think you deserve: sam@phonepanel.app. A real person reads it.
